Terms of Service
Effective 2026-10-14
These terms apply between Notique Inc. (주식회사 노티크, “we”), which operates Ears (ears.dev), and the people who use it. Makers are told these terms apply when they sign in, and respondents when they take part in a form.
1. Definitions
- Maker — a member who creates forms and receives responses
- Respondent — a person who answers a form. Respondents don't sign in.
- Form — a set of questions, fields, first-screen text and AI instructions
- Response — what a respondent says or writes, the values entered in fields, and the AI-generated summaries based on them
2. The service
Ears is an AI conversational form service. We provide:
- Creating forms — set questions, fields and how the AI asks, in the web editor or from an AI tool connected over MCP.
- Collecting responses — people with the link, or who find a form on the home page, answer by text or voice while the AI asks follow-up questions.
- Reviewing results — makers see the transcript, per-question summaries and field values.
- The public home page — forms a maker sets to “Public on home” are featured on ears.dev.
Ears is in beta. We open sign-up in the order and scope we choose; for now, only Google accounts we have invited can create forms.
3. Accounts
- Makers sign in with a Google or GitHub account. You must be 14 or older, which you confirm on the sign-in screen.
- Don't share access to your account or to AI tools connected to it. Activity through your account or connected tools counts as your activity.
- If you sign up on behalf of a company or organization, you must be authorized to accept these terms for it.
- You may not sell or transfer your account.
4. Makers' responsibilities
Makers are responsible for their forms and the responses they receive. Because the maker decides what respondents' personal data is used for and how, the maker is the controller of responses and must comply with applicable law, including Korea's Personal Information Protection Act.
- Your data processing notice must truthfully say who sees responses, what they are used for, how long they are kept, and how to ask for deletion.
- Don't ask for or accept government identifiers, sensitive data (such as health, beliefs, political views or sex life), bank or card numbers, or passwords.
- Don't create forms aimed at children under 14.
- If you want to send marketing to emails respondents leave, get the separate consent the law requires.
- Don't instruct the AI to deceive respondents (for example, by claiming to be human), harass them, or push them toward particular answers.
- Only include product information and links you own or are allowed to use.
- When you move responses elsewhere, including to AI tools connected over MCP, handle them in line with your data processing notice and the law.
5. Processing responses on your behalf
- While you run a form, you entrust us with collecting, storing, organizing and AI processing of its responses. We process responses only for that purpose and apply the security measures in our Privacy Policy.
- We delegate part of the processing to the providers in section 8 of the Privacy Policy (Supabase, Vercel, Anthropic, ElevenLabs, Cloudflare, Amazon Web Services). If that list changes, we announce it in the policy and in the service before it takes effect; if you don't agree, you can stop using Ears and ask us to delete responses before then.
- The first screen respondents see tells them that we process their answers for the maker and send them to providers abroad. Write your own data processing notice to match.
- On forms with recording turned on (Pro), we keep a recording only for voice answers whose respondent separately agreed. Use recordings only for the purposes you told respondents about.
- When a form is deleted or an account ends, we delete responses as described in section 10 of the Privacy Policy.
6. Respondents
- Your answers go to the maker who created the form. Check the data processing notice on the first screen to see how they will be used.
- The AI runs the conversation. Voice answers are kept as text; a recording is kept only on forms where the maker turned on recording and you separately agree.
- Don't say or type sensitive information such as government ID numbers, health information, bank or card numbers, or passwords.
- You can delete your answers on the closing screen (for public links, until you close it), and after that you can ask the maker or us (Privacy Policy, section 11).
- We don't vouch for what makers write in their forms or for how they use responses. Report a suspicious form to hello@ears.dev.
7. The public home page
- Forms set to “Public on home” are featured on the ears.dev home page while they accept responses. Response content is never shown.
- While a form is public on the home page, makers allow us to use its public information (product name and one-liner, public title and introduction) inside the service and in our own channels (such as newsletters and social media) to introduce Ears. If you'd rather we didn't use it in our channels, tell us — whatever the form's visibility.
- We decide which forms appear on the home page and in what order, and may remove a form from the home page or stop it from accepting responses if it breaks these terms or the law.
8. AI output
- The AI's questions, per-question summaries and extracted field values may be wrong or incomplete. Check the transcript before making important decisions.
- We don't guarantee the outcome of decisions based on AI output (product decisions, revenue and the like).
9. Pricing and payment
- Ears has a free plan and a paid plan (Pro). Plan limits are as shown in the service; prices and the billing currency are as shown at checkout.
- Pro is a monthly or annual subscription that renews automatically for the same period until you cancel.
- Pro is sold by Polar as merchant of record, and the service is provided by us. Polar handles payment, receipts and tax, and Polar and its payment processor keep your payment details.
- You can withdraw within 7 days of payment for a full refund (Korea's Act on Consumer Protection in Electronic Commerce, Art. 17).
- You can cancel at any time from “구독 관리” (Manage subscription) in settings. A monthly subscription stays active until the end of the period you paid for and isn't charged again. If you cancel an annual subscription early, we refund the remaining period pro rata by days.
- Send refund requests to hello@ears.dev. Once we confirm, the refund goes back to your payment method through Polar.
- Before raising a recurring price or charging for something that was free, we give 30 days' notice and ask for your consent. Without it you are not charged the higher amount, and the subscription ends at the end of that period.
- If someone under 19 paid without a legal guardian's consent, they or their guardian can cancel the payment.
10. Prohibited conduct
You may not:
- impersonate another person or organization, or create phishing forms that try to obtain passwords or payment details;
- create forms or instructions that break the law or infringe others' rights (copyright, portrait rights, personal data and so on);
- put sexual, violent, hateful or discriminatory content, or content harmful to children and young people, into forms or AI instructions;
- collect respondents' contact details to send spam or advertising;
- flood forms with automated responses, or get around bot checks, rate limits or usage limits;
- overload the service or its API, exploit vulnerabilities, or try to access areas you're not authorized to;
- copy or resell the service without permission, or make something look like part of Ears without our permission.
If we find any of this, we may take the form down or stop it from accepting responses and restrict the account. Unless it is urgent because others are being harmed, we tell you first and give you a chance to explain. Where we suspect a violation of law, we may cooperate with requests from the authorities.
11. Rights
- As between you and us, makers own the forms they create and the responses they receive. Makers allow us to store, process and display them as needed to provide the service.
- Responses go to the maker, and how they are used follows the maker's data processing notice and applicable law.
- We own the service itself: the software, its screens, the “Ears” mark and how the AI runs conversations.
12. Changes to and suspension of the service
We may change or suspend part of the service for equipment maintenance or replacement, provider outages or policy changes, changes in law, or business reasons. We announce significant changes or suspensions in advance, and outages we can't foresee afterwards.
If we shut the service down entirely, we will give 30 days' notice so makers have time to review and move their responses. If we shut down or remove a major feature during a paid period, we refund the remaining period pro rata by days.
Sign-in, the database, voice and AI processing, and payments depend on outside providers. Delays or outages caused by them may be beyond our control.
13. Termination
Makers can stop using Ears at any time and delete their account right away with “Delete account” in settings, or ask us at hello@ears.dev (we act within 10 days of the request). Deleting an account deletes its workspace's forms and responses. A paid subscription that is set to renew must be canceled before the account is deleted; cancellation and refunds follow section 9.
If a maker seriously breaches these terms, we may restrict or terminate the account and will tell them why by email.
14. Damages and limitation of liability
If we cause you damage intentionally or negligently, we compensate you under applicable law. We are not liable for damage caused by events beyond our control, such as natural disasters or provider outages, or by reasons attributable to you.
For damage caused by our minor negligence, we are not liable while you use the free plan, to the extent the law allows; while you use a paid plan, our liability is limited to what you paid for Ears in the 12 months before the event (including payments through Polar). These limits don't apply to damage caused by our intent or gross negligence, or to liability that can't be limited by law.
If a third party brings a claim against us because of a maker's form or how they handle responses, the maker must help resolve it and compensate us for damage caused by reasons attributable to the maker.
15. Changes to these terms
When these terms change, we publish the effective date and what changed on this page. Changes unfavorable to users are announced 7 days in advance (30 days for changes about fees or important rights), and to makers by email as well, together with a note that not objecting by the effective date counts as acceptance. If you don't agree, you can cancel before the change takes effect, and paid subscriptions are refunded pro rata for the remaining period.
16. Governing law and jurisdiction
These terms and your use of the service are governed by the laws of the Republic of Korea. We'll first try to resolve disputes by talking; otherwise they go to the competent court under the Korean Civil Procedure Act. Consumers may bring a claim in the court for their place of residence.
If the Korean and English versions of these terms differ, the Korean version prevails.
